These terms govern your use of the Fetch Barbados platform. Fetch Barbados is a product of Exarsys Ltd.

01 The Nature of the Marketplace
Fetch Barbados provides a platform for Merchant Partners to sell surplus food ("Fetch Bags"). Exarsys Ltd. acts as a facilitator and does not own, cook, or handle the food.
No Ownership: Fetch Barbados does not own, cook, or handle the food.
Contract of Sale: When you buy a bag, the legal contract is between you and the Merchant Partner.
02 Account and Eligibility
You must be at least 18 years old to create an account.
You are responsible for all activity under your username and for keeping your password secure.
03 Order, Pickup, and Forfeiture
The Pickup Window: Every order has a strictly defined collection time.
No-Show Policy: If you do not collect your food within the designated pickup window, the Merchant is entitled to dispose of or sell the unclaimed bag. No refund will be issued in such circumstances.
Receipts: You must present your in-app digital receipt to the Merchant staff to claim your order.
04 Location Services and Navigation
The App relies on GPS data to function. Fetch Barbados is not liable for navigation errors, map inaccuracies, or data charges incurred while using the App.
Continued use of GPS in the background may reduce battery life.
05 Food Safety, Allergens, and Liability
Important: Fetch Bags contain surplus items that vary daily. You must ask the Merchant Partner for ingredient details at the point of pickup if you have any allergen concerns.
The "Surprise" Element: Fetch Bags contain surplus items that vary daily.
Allergen Responsibility: Fetch Barbados cannot guarantee that items are free from allergens. You must ask the Merchant Partner for ingredient details at the point of pickup.
Merchant Responsibility for Food Complaints: The Merchant Partner is solely responsible for all complaints, disputes, or issues arising from the quality, safety, or content of the food provided. Any dispute relating to the food must be handled directly between the customer and the Merchant Partner. Fetch Barbados acts solely as a facilitator and is not a party to any such dispute.
Limited Liability: To the extent permitted by Barbados law, Fetch Barbados is not liable for any illness, injury, or loss arising from the consumption of food provided by Merchants.
06 Merchant Partner Requirements and Permits
All Merchant Partners must meet the following requirements before joining and throughout their time on the Fetch Barbados platform.
Valid Permits: Merchants must hold all valid and current permits required to prepare, handle, and sell food under Barbados law. Membership on the platform is conditional on all applicable permits being obtained and remaining valid at all times.
Ongoing Compliance: It is the Merchant's responsibility to maintain all permits in good standing and to notify Fetch Barbados promptly of any change in their licensing status.
Removal from Platform: Fetch Barbados reserves the right to suspend or permanently remove any Merchant Partner from the platform if they fail to adhere to the requirements set out in this policy, if their permits lapse or are revoked, or if there are excessive or repeated complaints from customers regarding that Merchant.
07 Cancellations and Refunds
Customer Cancellations: You may cancel up to 1 hour before the pickup window begins for a full refund.
Merchant Cancellations: Merchants may cancel an order if no surplus is available.
08 Governing Law
These terms are governed by the laws of Barbados. Any disputes shall be subject to the exclusive jurisdiction of the Barbadian courts.
09 Platform Liability
Fetch Barbados strives to maintain a reliable and uninterrupted service, but cannot guarantee this at all times. To the extent permitted by Barbados law:
Merchant Partners: Fetch Barbados is not responsible for any lost sales, lost revenue, or any other losses suffered by Merchant Partners arising from technical issues, outages, errors, or any other failure of the platform.
Users: Fetch Barbados is not responsible for any lost reservations, missed pickup opportunities, or any other losses suffered by Users arising from technical issues, outages, errors, or any other failure of the platform.
10 User Strike System and Suspension
Please note: Repeated failure to collect reserved orders will result in a strike being issued to your account. Accumulating 3 strikes will result in a temporary suspension from the platform.
Strike Issuance: A strike will be added to a User's account each time they fail to collect their reservation within the designated pickup window without cancelling in advance.
Account Suspension: Upon accumulating 3 strikes, the User will be blocked from the platform for a duration of 1 month.
Right to Amend Suspension Duration: Fetch Barbados reserves the right to change the duration of any suspension at any time and without prior agreement from the User or any Merchant Partner.
Right to Remove Users: Fetch Barbados reserves the right to suspend or permanently remove any User from the platform if they fail to adhere to the requirements set out in this policy.
